Explorer Saver – Participating Merchant Terms and Conditions

Welcome to the Explorer Saver program! These Terms and Conditions (the "Agreement") outline the responsibilities and requirements for merchants (the "Merchant") participating in the Explorer Saver program. By participating in this program, you agree to the terms set forth below.

The Explorer Saver enables Cardholders to receive discounts and benefits at participating merchants, including but not limited to:
  1. Cafes
  2. Souvenir and merchandise shops
  3. Car rentals
  4. Airport transfers
  5. Home stays or accommodations

  1. Participation Eligibility
    To participate in the Explorer Saver Card program, the Merchant must:
    • - Be a registered business with a valid operating license.
    • - Agree to abide by these Terms and Conditions and cooperate with Explorer Saver Card program administration.
    • - Meet the specific requirements set by Explorer Saver Card program, including offering designated discounts and benefits to cardholders.
  2. Merchant Benefits
    As a participating Merchant, you will receive exposure through the Explorer Saver Card program, which can drive customer traffic to your business. The program helps you connect with Explorer Saver Cardholders who are seeking discounts and benefits at your establishment.
  3. Discounts and Benefits
    Participating Merchants must offer the agreed-upon discounts and/or benefits to valid Explorer Saver Cardholders. The discount and benefit structure must be clearly communicated to Explorer Saver and must not be altered without prior written consent from Explorer Saver
    The Merchant must ensure that the discount or benefit is applied correctly when a valid Explorer Saver Card is presented. Discounts or benefits are non-transferable and only available for personal use by the cardholder. Discounts cannot be combined with other offers, promotions, or discounts unless explicitly stated in writing by Explorer Saver .
  4. Merchant Responsibilities
    • - Validating Cards: The Merchant must verify that the card presented by the customer is an active Explorer Saver Card If in doubt, the Merchant should confirm the cardholder’s eligibility with Explorer Saver Card before offering any discounts or benefits.
    • - Customer Service: The Merchant must provide the same level of customer service to Explorer Saver Cardholders as they would to any other customer.
    • - Offer Terms: The Merchant must ensure that all offers or discounts made available to Cardholders are clear, fair, and well-promoted at the point of sale.
    • - No Additional Charges: The Merchant agrees not to charge extra fees for the use of the Explorer Saver Card
  5. Liability and Indemnity
    The Merchant is responsible for the delivery of services or products provided to Explorer Saver Cardholders. Explorer Saver does not guarantee the quality of the goods or services offered by the Merchant.
    The Merchant agrees to indemnify and hold harmless Explorer Saver its affiliates, and its employees from any claims, losses, or damages arising out of the Merchant's participation in the program, including but not limited to disputes with customers over discounts or services provided.
  6. Marketing and Promotion
    As a participating Merchant, you agree to display promotional materials provided by Explorer Saver such as signs, posters, or digital assets, in your business to inform Cardholders of your participation in the program.
    Merchants may also be included in marketing communications, such as emails, website listings, or social media posts, promoting your participation in the Explorer Saver program.
    You agree to provide Explorer Saver with up-to-date information about your offers, hours of operation, and any changes that may affect Cardholder benefits.
  7. Termination of Participation
    Explorer Saver reserves the right to terminate or suspend any Merchant’s participation in the program at its sole discretion, including but not limited to:
    • - If the Merchant fails to honor the discount or benefit for Cardholders.
    • - If the Merchant engages in fraudulent or unethical practices.
    • - If the Merchant is found in violation of any of these Terms and Conditions.
    • - If the Merchant’s participation could harm the reputation or integrity of the Explorer Saver program.
    The Merchant may also request to terminate participation by notifying Explorer Saver in writing with a notice period of 30 days.
  8. Term and Renewal
    The Merchant’s participation in the Explorer Saver program is valid for a period of 3 (3) years, unless otherwise agreed upon. Upon expiration, both parties may review the terms and decide whether to renew the participation agreement.
    Either party can terminate the agreement at any time, with or without cause, by providing 30 days written notice to the other party.
  9. Changes to Terms
    Explorer Saver reserves the right to modify, amend, or update these Terms and Conditions at any time. Changes will be communicated to the Merchant in writing or electronically. Continued participation in the program after the changes are communicated will constitute acceptance of the updated terms.
  10. Confidentiality
    The Merchant agrees to maintain the confidentiality of any proprietary or confidential information received from Explorer Saver. This includes details about discounts, promotional strategies, or any business-sensitive data provided by Explorer Saver.
  11. Governing Law
    These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysian. Any disputes between the parties arising from this agreement shall be resolved in the courts of Malaysia.
